The only sad person here is someone who can't spell, can't construct a sentence to save his life and doesn't know how to use punctuation. You have 3 boards on which to call Matt a drunk, why come here? Stay where you belong Oregondad.

They made two episodes about this so this is a relative topic. Also, by your own statement unless you are there you cant convict some one of a crime, well that would make for a pretty bad legal system wont it. Also as far as a lawyer saying not to take a breathalyzer I have it from 2 criminal defense lawyers:

'Don’t Refuse the Breathalyzer. If you are stopped for a DUII, the police officer is likely to ask you to take a breathalyzer test, perform field sobriety tests, or both. Never refuse the breathalyzer. By statute, refusing the breathalyzer represents a conclusive presumption of your guilt, and the DMV penalties are more severe. Take the breathalyzer"

Talk to a lawyer who knows what their doing and you will see unless your drunk, you DO NOT refuse a breathalyzer

It's sad and older lady who seems to be on these boards all day everyday, go outside try meating actual people, make friends in real life.

It's also sad that you dont have the smarts to figure out I am not Oregondad, it's sad that god creates some people that just arent able to function in society, but I guess you realized that and thats why you've become the person you are. A sad bitter woman with noting to do but attack those she see's are better than her. You have my sympathy, I really do feel bad for you

No, my statement was I won't convict someone without the facts. As so many have convicted Matt without the facts.
"I wasn't there" refers to the fact that I wasn't with Matt that day, so I don't know what happend. Many sure talk like they were. So all I have to go on are the facts that have been presented. I wont convict someone without them, and that sounds like a pretty good legal system.
Perhaps Matts lawyer was taking into consideration that Matt is a little person with diabetes. Diabetics can have false readings on a breathalizer.
Perhaps you should run that by your criminal defense lawyers.

I had not heard of the diabetes and breathalyzer being effected. I am going to ask about this Tomm, I know some guys who work in the Police training academy down here.

A rookie in the Police Academy isn't going to have all the answers.

The Breathalyzer is an excellent tool that can be used to measure BAC, but it's not without fault. Just Google "Problems Breathalyzer" You'll find all the scientific studies that have been done. Not only can acetone from a diabetic cause problems, but painting with an oil based paint, mouthwash... etc..can cause problems. It's still an effective tool, but not without fault.
